Please read this carefully before installing the Changi App (Changi Airport flight enquiry, information and directory) application (collectively the “Software”) provided by Changi Airport Group (Singapore) Pte. Ltd. (“CAG”).

By installing or using the Software, you indicate acceptance of these terms set out herein, including those additional relevant terms and conditions and policies  referenced herein, on our website and/or available by hyperlink. If you do not accept these terms, you should not install or use the Software. 
 

Please note that if you log into your Changi account, the Changi account Terms and Conditions will apply.

1. Ownership of materials

The Software, and all related materials and documentation, as well as all upgrades and updates thereto (collectively, the “Licensed Application”) are copyrighted works, and are also protected under applicable database laws. CAG (or, where applicable, its licensors) has and retains ownership of the Licensed Application and all intellectual property rights (including copyright, trade marks and designs) therein. Any rights granted to you under these Terms of Use shall not in any way constitute a sale or assignment of the original Licensed Application or the intellectual property rights therein. 
 

2. Licence

2.1  CAG grants to you a revocable, limited, non-exclusive, non-transferable licence to use the Licensed Application on any device that you own or control and subject to all applicable terms and conditions in the App Store Terms and Conditions. 
 

2.2  You shall not:

    (i) use the Licensed Application on any device that you do not own or control;

    (ii) rent, lease, sub-licence, sell, assign, transfer or otherwise dispose of the Licensed Application, on a temporary or permanent basis;

    (iii) distribute or make the Licensed Application available over a network where it may be used or accessed by multiple devices at the same     time

    (iv) reproduce, copy, reverse engineer, decompile, disassemble, modify or create derivative works based on the Licensed Application; or

    (v) vary, delete or obscure any notices of proprietary rights or any product identification or restrictions on or in the Licensed Application.
 

3. Use of data

You shall permit CAG to collect, use and disclose data and information originated by you and made accessible to CAG in the course of, or as a result of, your use of the Licensed Application, for the purpose of facilitating the provision of updates, product support and other services to you (if any) in relation to the Licensed Application, in addition to the purposes set out in, and at all times in accordance with, CAG’s Privacy Policy.

4. Term

These Terms of Use are effective until terminated by written notice from CAG. They will terminate automatically without further notice from CAG, in the event of any failure by you to comply with any of the terms and conditions herein. Upon termination of the same, you shall cease all use of the Licensed Application, and remove all copies of the Licensed Application and associated files from your devices and cloud storage. 
Notwithstanding the foregoing, any termination of these Terms of Use shall be without prejudice to any rights or remedies accrued by CAG prior to the date of termination, including in respect of any breach by you of these Terms of Use. 

5. Warranties and Disclaimer

5.1  Without prejudice to clause 5.2, while every effort will be made by CAG to ensure that flight information provided through the Licensed Application is correct, the dates, time and other details provided may, from time to time, be changed without notification. CAG is not responsible for any incorrect information and is therefore not liable in any way for inaccuracies or errors in the same. You should consult with the airlines and/or relevant third parties directly to obtain updated and accurate information. Flight notifications are sent using the push notifications. Delivery of flight notifications by push notification is made on a “best effort” basis and is not subject to any warranty by CAG. While no SMS charges will be incurred for flight notifications, data charges may apply for use of the Licensed Application. 

5.2  You acknowledge and agree that the Licensed Application, and any information provided through the Licensed Application (“Application Content”), is provided to you purely on an “as is” basis, and your use of the Licensed Application and/or Application Content shall be entirely at your own risk. To the extent permitted by law, CAG: 

         (i) disclaims all warranties with respect to the Licensed Application and Application Content, including but not limited to any implied warranties relating to quality, fitness for any particular purpose, quiet enjoyment and non-infringement of third party rights; 

          (ii) makes no warranty that the Licensed Application or Application Content is error free or that your use of the Licensed Application or Application Content will be uninterrupted, and you acknowledge and agree that the existence of such errors and occurrence of such interruptions shall not constitute a breach of these Terms of Use; and 

          (iii) does not give any warranty of any kind in respect of any third party services or products that may be made accessible to you through or from the use of the Licensed Application. 

5.3 To the extent not prohibited by law, CAG will in no event be liable to you for personal injury or for any damages, including any lost profits, lost savings, loss of data or any indirect, special, incidental or consequential damages arising out of the use of or inability to use the Licensed Application or Application Content or any part thereof. 

5A. Third Party Links 
Occasionally there may be content, products and services that are made available on the Licensed Application through third parties. Third-party links may direct you to third-party websites or applications that are not affiliated with CAG. CAG is not responsible for examining or evaluating the content or accuracy, nor do we provide warranties, for any third-party materials, information or applications, or for any other materials, products or services of third-parties. CAG will not be liable for any harm, loss or damages suffered by you in relation to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites or applications.  
 

6. General

6.1  These Terms of Use may be amended at any time by CAG. Any use by you of the Licensed Application subsequent to the any amendment made by CAG to these Terms of Use , shall be deemed to be an acceptance by you of such amendment.
 

6.2  No delay, neglect or forebearance by CAG in enforcing against you any term or condition of these Terms of Use shall be deemed to be a waiver or in any way prejudice any right of CAG. No right, power or remedy in these Terms of Use conferred upon or reserved for either party is exclusive of any other right, power or remedy available to CAG.
 

6.3  These Terms of Use and all matters arising from it and any disputes in respect thereof, shall be governed by and construed in accordance with the laws of the Republic of Singapore. Both CAG and you hereby irrevocably submit to the non-exclusive jurisdiction of the Singapore courts.
 

6.4  These Terms of Use supersedes all prior agreements, arrangements and undertakings between you and CAG and constitutes the entire agreement between you and CAG in relation to the Licensed Application.
